The on-line shop was set up to raise funds for our campaign through the sale of Devon for Europe merchandise. Do tell us if you think there are products we could add to our range.

General Information

Any purchase of goods from Devon for Europe (THE MERCHANT) at the site www.devonforeurope.org (THE MERCHANT SITE) requires the customer to consult and accept these terms and conditions. The click validating the order implies full acceptance of these terms and represents the customer's "digital signature".

 

Making a Purchase

From the Devon for Europe home page, click on the "Shop" page. Once in the catalogue navigate to your chosen item. By clicking on it you can see detailed information about the product. To buy a product click on the "Add To Basket" button. A new page will ask you to confirm the product, after which you can go to checkout, continue shopping or cancel. You can check and edit the contents of your shopping basket at any time by clicking the "Basket". When you have found all the items you require, click on "Checkout" to make your purchase. Follow the onscreen instructions to complete the order process. Your order will not be processed until you enter your payment details in the PayPal screen and press the final submit button. On doing so, you will receive an email confirmation.

 

Proof of Transaction

The records stored in THE MERCHANT's computer systems (under the GDPR compliance regime for the site as whole) are considered proof of communications, orders and payments made between the parties.

Every effort has been made to ensure the accuracy of the information presented on this website. We shall not be held liable for the consequences, accidents, or special damages arising from any inaccuracy of the information presented. Product photos, descriptions and prices are non-contractual.

 

Stock Levels

Whilst we make every effort to ensure that stock levels are ‘live’, it can happen that even though an item is shown in stock, we do not actually have it in stock. This can be caused by two people trying to buy the item at the same time, or if we sell the item off line (telephone order etc.) and the stock control is not yet updated. Should this happen, we will always contact you with the estimated delivery date and the option to amend or cancel your order.


Validity Period of Offer and Prices

Our offers and prices are valid for the day the site is consulted and are subject to change without notice.


Shipping and Handling

UNITED KINGDOM ONLY


For orders shipped to a UK address the postage and packing charge is £2.95 for orders up to £24.00. For orders over £24.00 shipped to a UK mainland (excluding Highlands and Islands) address, the postage and packing charge is FREE

 

Delivery Schedule

 

We aim to dispatch orders received by 17:00 on the next working day. Should an item be out of stock we will always contact you with the estimated delivery date and the option to amend or cancel your order.

Although orders are usually delivered much faster, please allow 5 working days.


Delivery Terms: Products are delivered to the address specified by the customer on the purchase order.

 

Loss or Damage in Transit

THE MERCHANT will not be responsible for damage or loss of goods or part thereof in transit or for any discrepancy between the goods delivered and the goods ordered unless the customer gives written or email notice of a claim to THE MERCHANT and the carrier within two (2) business days of delivery.


In the event of damage of goods or part thereof in transit or for any discrepancy between the goods delivered and the goods ordered, the customer must hold the goods and make them available for inspection or collection by THE MERCHANT or its representatives on request.

Please notify Devon for Europe if your item has not arrived within 7 days of order confirmation.


In the case of delivery error, all goods to be exchanged or refunded must be returned to THE MERCHANT in whole, in its original packaging and in perfect condition to THE MERCHANT ADDRESS.


For claims to be accepted, the customer must first make a declaration to THE MERCHANT concerning any returns and receive and THE MERCHANT's consent. If accepted, the customer will ship the package to THE MERCHANT ADDRESS.


Shipping fees shall be at THE MERCHANT's expense, except in the case where the goods do not correspond to the original declaration made by the customer concerning the return.


Warranty

The provisions hereof cannot deprive the customer of their right to legal warranty requiring THE MERCHANT to protect the customer against latent defects of goods sold.

 

Back Orders

If your item is not in stock, we will back order it for you. You will always be emailed with the estimated delivery date and the option to cancel your order if you would rather not wait.

Credit Card and Information Security. 

All card payments will be handled by PayPal so we do not have access to your card details. All other personal information (such as your name and address and email address) is kept in a secure environment, whether it is kept electronically or in printed form. Printed documents are kept for our records as long as required by law, after which they are destroyed.

Devon for Europe will never disclose customer information to any third parties. Cookies are used on this shopping site to keep track of the contents of your shopping cart once you have selected an item. Data collected by this site is used to:

a. Take and fulfil customer orders

b. Administer and enhance the site and service

c. Only disclose information to third-parties for goods delivery purposes.

 

Returns Policy

DO NOT RETURN ITEMS WITHOUT PRIOR AUTHORISATION.


In accordance with the Distance Selling Regulations 2000, the customer has the right to a cooling off period of fourteen (14) business days, starting at the time goods are received, to cancel the contract and return said goods at their own expense, for any reason.

 

If you would like to return an item for a refund, please email sales@devonforeurope.org within 14 days of receipt of goods to obtain a returns number, which must be included with the item.

 

We will also provide you with a returns address. When returning items, please obtain proof of postage. Unless the items are faulty all returns are at the customer's expense. Only complete and unused goods in perfect condition for resale will be accepted.


If you change your mind about your purchase within the 14 day period we will refund the cost of the item and the original delivery cost as follows:

-If the item was part of a larger order, there will be no delivery charge refund.

-We will refund standard delivery charges only, not additional delivery charges for guaranteed special delivery.

If an exchange is requested, all shipping expenses shall be the responsibility of the customer.


Faulty items - If the item you would like to return is faulty or the item you received is incorrect, please email shop@devonforeurope.org and we will contact you about how to return the item. Please do NOT return any faulty items without first contacting us. The above does not affect your statutory rights.

 

If the right to withdrawal is exercised, THE MERCHANT will make every effort to refund the customer within 7 days of receiving the returned goods.

 

Right of Use

Partial Invalidity

These terms and conditions remain valid and in force, even if one or more clauses are invalid or declared so under any law, regulation or following the final decision of a competent court.

 

Non-Waiver

No failure of either party to exercise any power given to it in these terms and conditions or to insist upon strict compliance by the other party with its obligations hereunder shall constitute a waiver of either party's right to demand exact compliance with the terms hereof.

All personal data you provide us is used to process your orders. This data will be treated in accordance with The Data Protection Act 2018. Full details here.


Applicable Law and Competent Jurisdiction

In form and content, these Terms and Conditions shall be governed by and construed in accordance with English law. All orders placed on THE MERCHANT SITE strictly imply the acceptance of THE MERCHANT's terms and conditions.


In case of dispute or claim, the customer agrees to seek an amicable solution with THE MERCHANT before proceeding with any legal action. In the event where such a solution cannot be found, any disputes concerning the sale (price, Terms and Conditions, products, etc.) will be subject to the exclusive jurisdiction of the English courts.
